These Terms of Service ("Terms") govern your use of www.patche.store and any purchase you make from us. Please read them before ordering. By using this website or placing an order, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the site.

1. About us

This website is operated by Patche, a business based in New Zealand. "We", "us" and "our" refer to Patche. "You" refers to the person using the site or placing an order. You can reach us at info@patche.store.

2. Using this website

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You agree to give accurate and complete information when you order, and to keep your account details secure if you create an account.

3. Our products

Patche sells hydrocolloid and salicylic acid patches and related skincare products. We've made every effort to describe and photograph our products accurately, but colours and appearance can vary depending on your screen. Packaging and formulation may change from time to time.

All products are subject to availability. We may limit quantities, change descriptions, or discontinue a product at any time without notice.

4. Our products are not medical advice

Patche products are cosmetic skincare products. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition.

Nothing on this website — including product descriptions, blog articles and any guidance we publish — is medical advice, and it is not a substitute for advice from a doctor, dermatologist or pharmacist. Results differ from person to person, and we can't promise a particular outcome for your skin.

Always read the label and follow the directions for use. Stop using the product and seek medical advice if you experience irritation or an adverse reaction. If you are pregnant, breastfeeding, taking prescription acne medication, or have a diagnosed skin condition, please speak to a healthcare professional before using salicylic acid products.

5. Orders

When you place an order you are making an offer to buy. Your order is accepted only when we send you a dispatch confirmation. We may decline or cancel an order — for example if a product is out of stock, if there has been a pricing error, or if we suspect fraud — and if we do, we'll refund you in full.

If your order hasn't been dispatched, email info@patche.store and we'll cancel it for you.

6. Prices and payment

Prices are shown in your local currency where we support it, and otherwise in New Zealand dollars. Prices include GST where applicable and exclude shipping unless stated. Shipping is added at checkout and is shown before you pay.

Prices, discounts and promotions can change at any time, but the price that applies to your order is the price shown at the time you place it. Import duties and taxes for deliveries outside New Zealand are not included and are your responsibility.

By submitting payment details you confirm you are authorised to use that payment method.

7. Shipping and delivery

Delivery costs, processing times and estimated delivery windows are set out in our Shipping Policy, which forms part of these Terms. Delivery estimates are estimates only and are not guaranteed. Risk in the products passes to you on delivery.

8. Refunds

Our Refund Policy forms part of these Terms. In short: we offer a 30-day money-back guarantee, we don't accept returns or exchanges, and you don't need to send anything back to claim a refund.

9. Your consumer rights

If you are in New Zealand, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 give you rights that cannot be excluded. If you are in Australia, the Australian Consumer Law does the same. Similar protections may apply where you live. Nothing in these Terms limits or excludes those rights, and where any part of these Terms conflicts with them, those rights prevail.

Where the law permits, the Consumer Guarantees Act does not apply to goods bought for the purposes of a business.

10. Intellectual property

All content on this website — including text, photographs, graphics, logos and the Patche name — belongs to us or our licensors and is protected by New Zealand and international intellectual property law. You may view and share our content for personal, non-commercial use. You may not copy, reproduce, republish or use it commercially without our written permission.

11. Acceptable use

You agree not to use this website for any unlawful purpose, to upload malicious code, to scrape or harvest data, to attempt to gain unauthorised access, to impersonate anyone, or to interfere with the operation of the site or anyone else's use of it. We may suspend or refuse access if you do.

12. Reviews and other content you submit

If you send us a review, photograph, suggestion or other content, you confirm it is your own, that it is honest, and that you have disclosed any incentive you received for providing it. You grant us a royalty-free, worldwide licence to use, reproduce and display that content in connection with our business. We may edit or remove content that is unlawful, misleading, offensive or infringes someone else's rights.

13. Third-party links and services

This website may link to or embed services operated by third parties. We don't control those services and aren't responsible for their content, products or privacy practices. Your dealings with them are between you and them.

14. Errors and availability

We try to keep the site accurate and available, but we can't promise it will be uninterrupted or error-free. Occasionally there may be typographical errors or inaccuracies relating to descriptions, pricing, promotions, shipping charges or availability. We reserve the right to correct them and to cancel any order placed on incorrect information, refunding you in full.

15. Disclaimer and liability

Except as set out in section 9 and to the extent permitted by law, this website and our products are provided "as is", and we exclude all implied warranties.

To the extent permitted by law, our total liability to you in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost profits or lost data. Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, or for fraud.

16. Indemnity

You agree to indemnify us against any claim, loss or cost arising from your breach of these Terms or your misuse of this website.

17. Privacy

How we collect and handle your personal information is set out in our Privacy Policy. We handle personal information in accordance with the New Zealand Privacy Act 2020.

18. Changes to these Terms

We may update these Terms from time to time by posting a revised version on this page. The version in force when you place an order is the one that applies to that order.

19. General

If any part of these Terms is found to be unenforceable, the rest continues to apply. Our failure to enforce a right isn't a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours.

20. Governing law

These Terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts. If you are a consumer resident elsewhere, you may also have the benefit of mandatory consumer protections in your country of residence.
